These Terms and Conditions govern your access to and use of the Movement Education website, digital learning platform, lesson videos, teaching resources, assessments, movement activities, programs, memberships, school licences, community resources, and other products and services offered by Movement Education.

By accessing our website, purchasing a product, creating an account, accessing educational resources, or otherwise using Movement Education, you agree to these Terms and Conditions.

If you do not agree with these Terms and Conditions, you must not use our website, platform, products, or services.

1. ABOUT MOVEMENT EDUCATION

Movement Education supports primary school teachers in delivering engaging, curriculum aligned movement and dance lessons without requiring extensive dance experience or significant lesson planning.

Our programs are designed to give educators practical, ready to use resources that support movement education from Foundation through Year 6.

References to "Movement Education", "we", "our", and "us" in these Terms refer to Movement Education and the operators of the Movement Education platform.

2. WHO OUR SERVICES ARE FOR

Movement Education is primarily designed for:

Primary school teachers

Schools

Education providers

School leaders

Physical education teachers

Classroom teachers

Other authorised educators

Students may participate in Movement Education activities under the supervision of their school, teacher, parent, guardian, or another responsible adult.

3. MOVEMENT EDUCATION PRODUCTS

Movement Education may offer several products and packages.

The inclusions, pricing, access period, and licence conditions applicable to each product will be displayed at the time of purchase.

4. MOVEMENT ENERGISER PACKAGE

The Movement Energiser Package is an upfront, one time purchase currently offered at a regular price of $297 unless otherwise advertised.

Different versions of the package may be available for different year levels.

Foundation to Year 2

The package may include:

2 cool down activities

2 empowerment messages

Teacher Class Engagement Blueprint

Pre and post assessment templates

Movement Games mini pack containing ready to use movement games and activities

Additional resources may be included depending on the offer available at the time of purchase.

The exact inclusions displayed on the relevant sales page at the time of purchase will form part of the purchase agreement.

5. MOVEMENT LEVEL UP PACKAGE

The Movement Level Up Package provides annual access to selected Movement Education resources.

The regular annual price may be $997 unless another price is displayed at the time of purchase.

The package may include:

Access to one complete movement module

10 lessons within the selected Foundation to Year 6 stream

12 months of access

Unlimited authorised users within the purchasing school for the selected module

Lesson videos

Lesson plans

Assessments

Teacher resources

Supporting educational materials

Access to the Movement Education educator community

Group support during the applicable access period

This package is intended for schools wishing to begin with a particular year level, teaching band, or movement module before progressing to additional Movement Education programs.

Access expires at the end of the applicable annual period unless renewed or otherwise stated.

6. MOVEMENT LEGACY PACKAGE

The Movement Legacy Package provides lifetime access to the Movement Education resources included in the offer at the time of purchase.

The regular price may be $2,997 unless another amount is displayed at the time of purchase.

The package may include:

Content covering Foundation to Year 6

More than 120 lesson videos where available

Lesson plans

Assessments

Teacher preparation resources

Supporting teaching resources

Future updates

New lesson content

New video content

Additional bonuses identified as part of the offer

Lifetime access refers to the operational lifetime of the relevant Movement Education product or platform.

It does not mean the lifetime of an individual purchaser.

Movement Education will make reasonable efforts to continue providing access to purchased lifetime resources while the applicable product and business remain operational.

7. PRODUCT INCLUSIONS

Movement Education may improve or update its products over time.

Images, examples, lesson counts, resource descriptions, bonuses, or program information displayed on marketing pages are intended to describe the applicable offer.

The specific inclusions provided at the time of purchase will determine what is included in your purchase.

Promotional bonuses may only be available during specified promotional periods.

8. SCHOOL LICENSING

Movement Education resources are licensed for educational use by the purchasing school or authorised purchaser.

Unless otherwise stated, access is limited to the school or organisation that purchased the licence.

Where unlimited school users are included, this means authorised staff members working within the purchasing school.

It does not permit access by other schools, external organisations, independent businesses, unrelated teachers, or members of the general public.

Schools must not share their login details or resources with other schools.

9. USER ACCOUNTS

Certain Movement Education products may require a user account.

You are responsible for maintaining accurate account information and protecting your login credentials.

You must not intentionally allow unauthorised users to access your account.

If you believe your account has been accessed without permission, you should contact Movement Education as soon as reasonably possible.

10. PERMITTED EDUCATIONAL USE

Teachers and schools may use Movement Education resources with their students for authorised educational purposes.

Resources may be displayed within the classroom and used as part of lessons covered by the applicable school licence.

Teachers may download resources where a download option is specifically provided.

Downloaded resources remain the intellectual property of Movement Education.

11. PROHIBITED USE

You must not:

Resell Movement Education materials

Redistribute paid resources to other schools

Share paid resources publicly

Upload paid resources to public websites

Publish lesson videos on social media

Record Movement Education videos for redistribution

Copy substantial portions of Movement Education programs

Share login credentials with unauthorised users

Remove copyright notices

Remove Movement Education branding

Represent Movement Education resources as your own original work

Use Movement Education materials to create a competing commercial program

Sell modified versions of Movement Education resources

Use automated technology to extract large quantities of content from the platform

Attempt to bypass security or access restrictions

Use the platform for unlawful purposes

12. INTELLECTUAL PROPERTY

All intellectual property rights relating to Movement Education remain owned by or licensed to Movement Education.

This includes:

Lesson plans

Teaching materials

Assessments

Movement activities

Dance routines

Music

Audio content

Movement games

Teacher guides

Blueprints

Written materials

Graphics

Photography

Illustrations

Templates

Downloads

Program structures

Website content

Branding

Logos

Digital products

You receive a limited licence to use the resources in accordance with the package purchased.

Purchasing a Movement Education product does not transfer ownership of the intellectual property to you.

13. PHYSICAL ACTIVITY

Movement Education includes physical movement activities.

Participation in any physical activity carries some inherent risk.

Teachers, schools, parents, guardians, and participants should ensure that the activity and environment are suitable before beginning.

Appropriate considerations may include:

Available space

Floor conditions

Student age

Student ability

Existing injuries

Medical conditions

Appropriate clothing

Appropriate footwear

Supervision

Equipment

School safety policies

Teachers remain responsible for determining whether an activity is appropriate for their class.

14. STUDENT SUPERVISION

Movement Education does not provide direct supervision of students.

Schools and educators remain responsible for supervising students participating in Movement Education activities.

Students should participate in accordance with applicable school policies and reasonable safety practices.

15. HEALTH CONSIDERATIONS

Movement Education content is educational in nature and does not constitute medical advice.

A participant who has a medical condition, injury, physical limitation, or other health concern should seek appropriate professional advice where required before participating.

Participants should stop participating if they experience pain, dizziness, significant discomfort, breathing difficulties, or other concerning symptoms.

16. CURRICULUM ALIGNMENT

Movement Education may describe certain resources as curriculum aligned.

This means that the resources have been developed to support relevant curriculum areas and learning outcomes.

Curriculum requirements may change.

Teachers and schools remain responsible for determining whether individual resources satisfy their current curriculum, reporting, assessment, or regulatory requirements.

17. EDUCATIONAL OUTCOMES

Movement Education is designed to support teachers in providing high quality movement education.

However, individual results may vary.

Movement Education does not guarantee a specific academic, physical, behavioural, engagement, professional, or educational outcome from the use of its programs.

18. PRICING

Prices will be displayed on the applicable Movement Education sales or checkout page.

Prices may vary depending on:

School package

Year level

Access period

Promotional offer

Special campaign

Bonus inclusions

Movement Education reserves the right to change pricing for future purchases.

A pricing change will not normally affect a purchase that has already been completed.

19. PAYMENT

Payment must be made through the payment methods made available by Movement Education.

Where a product is purchased through a one time payment, the full amount will generally be charged at checkout.

Where payment plans are offered, the applicable payment terms will be disclosed before purchase.

You agree to provide accurate billing and payment information.

20. ANNUAL ACCESS

Products providing annual access remain available for the stated access period.

Unless otherwise specified, annual access begins from the date access is activated.

At the end of the applicable access period, access may expire unless the service is renewed.

If automatic renewal applies to a particular product, this will be disclosed during the purchasing process.

21. LIFETIME ACCESS

Where Movement Education offers lifetime access, this means access for the operational lifetime of that Movement Education product.

Reasonable changes to the way the program is delivered

Movement Education may migrate content to another technology platform while maintaining reasonable access to the purchased materials.

22. FUTURE UPDATES

Where future updates are expressly included in a product, eligible customers will receive access to applicable updates that Movement Education releases for that product.

Revised curriculum resources

This does not necessarily include entirely separate products, premium services, coaching programs, or programs created outside the scope of the purchased package.

23. EDUCATOR COMMUNITY

Some packages may include access to a Movement Education educator community.

Community access may be subject to separate community guidelines.

Participants must communicate respectfully and must not:

Harass other members

Publish unlawful content

Share confidential information

Promote unrelated commercial services without permission

Share paid Movement Education content outside authorised use

Movement Education may remove community access where serious or repeated breaches occur.

24. BONUSES

Certain Movement Education packages may include bonuses.

Bonuses may include resources such as:

Additional educational resources

Bonuses may differ between promotions and may be withdrawn from future offers.

25. REFUNDS

Movement Education will handle refund requests in accordance with applicable Australian consumer law and any refund policy displayed when the product is purchased.

Nothing in these Terms is intended to exclude rights that cannot legally be excluded under the Australian Consumer Law.

A change of mind does not automatically create an entitlement to a refund unless otherwise stated or required by law.

26. AUSTRALIAN CONSUMER LAW

Our products and services come with guarantees that may apply under the Australian Consumer Law.

Nothing contained in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot legally be excluded.

Where information relating to children is provided to Movement Education, the school or responsible adult must ensure that the information is provided appropriately and that any required permission has been obtained.

31. TESTIMONIALS

Movement Education may display comments, testimonials, case studies, teacher feedback, and school feedback where appropriate permission has been provided.

Testimonials reflect the experiences of individual users.

They do not constitute a guarantee that every user will experience the same results.

32. SUSPENSION OF ACCESS

Movement Education may suspend or restrict access where there is reasonable evidence of:

Unauthorised account sharing

Non payment

Copyright infringement

Unauthorised distribution of resources

Fraudulent activity

Security threats

Illegal activity

Serious or repeated breaches of these Terms

Where reasonable, Movement Education will attempt to resolve the matter with the account holder.

33. TERMINATION

Movement Education may terminate access where a serious breach of these Terms occurs.

Termination does not transfer ownership of Movement Education materials to the purchaser.

Intellectual property restrictions continue after access ends.

34. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Movement Education is not responsible for indirect or consequential losses arising from the use of its website, platform, programs, or educational materials.

Schools and teachers remain responsible for professional decisions relating to their students, classrooms, and learning environments.

Nothing in these Terms limits liability where such limitation is prohibited by law.

35. CHANGES TO MOVEMENT EDUCATION

Movement Education may continue to develop and improve its programs.

36. CHANGES TO THESE TERMS

The date at the beginning of these Terms will indicate when the document was last updated.

37. GOVERNING LAW

These Terms are governed by the applicable laws of Australia and the Australian state or territory in which Movement Education operates, subject to any mandatory legal requirements that apply.

38. SEVERABILITY

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
